Giovanni Homes Corp. won a nearly $1.8 million award against Oncor Electric Delivery, Co. in a jury trial that took place in Tarrant County, TX. On December 21, 2010, the jury ordered Oncor Electric to pay the sum to the developer after Giovanni Homes was forced to wait an unreasonably long time for the utility provider to move a disruptive underground power line.
The power line, which was located through the property purchased by Giovanni Homes, held up development for almost two years. Oncor had signed a contract agreeing to move the power line, but failed to do so in a timely manner. The developer sued Oncor for breach of contract and unlawful trespass.
